Terms of Service

1. Introduction

These Terms of Service govern the provision of 3D garden design services by Shauna McGuigan Garden Design (“we”, “our”, or “us”) to our clients (“you” or “the client”). By engaging our services, you agree to these terms.

2. Scope of Services

Services are as outlined in the agreed proposal, which may include consultation, concept design, 3D visuals, mood boards, planting palettes, and other specified deliverables.

All designs are conceptual and for aesthetic/layout purposes only. They are not construction, structural, or engineering drawings. Measurements, gradients, and levels shown are indicative only and must be verified on site by a qualified contractor, engineer, or surveyor prior to works. Contractors are responsible for all technical specifications, grading, drainage, and safety compliance.

3. Fees and Payment

A 50% deposit is required to secure your design slot and commence work.
The remaining 50% is due upon completion of the design package, prior to the release of final files.
Payments are accepted via bank transfer (details provided on invoice).
All fees quoted include VAT where applicable.

Failure to make payment within agreed terms may result in project delays or suspension of work.

4. Revisions

Each design package includes one round of minor revisions following presentation.
Additional revisions, design amendments, or layout changes requested outside the agreed scope may incur additional fees, charged at our hourly design rate.

5. Ownership and Copyright

All design materials, drawings, 3D models, and images remain the intellectual property of Shauna McGuigan Garden Design until full payment is received.
Upon full payment, the client is granted a non-exclusive licence to use the design for their own private garden project.
Designs, images, and renders may be used by Shauna McGuigan Garden Design for portfolio, marketing, and social media purposes unless otherwise agreed in writing.

6. Accuracy and Liability

While every effort is made to ensure designs are accurate and achievable, all measurements, visuals, and recommendations are illustrative and must be verified on site by the contractor prior to construction.
Shauna McGuigan Garden Design accepts no liability for:

Variations arising during construction or planting.
Issues resulting from inaccurate site information supplied by the client.
The performance of contractors or suppliers recommended to the client.

7. Cancellations

If you wish to cancel your project after the deposit is paid but before design work begins, a 10% administrative fee will apply.
Once design work has commenced, deposits are non-refundable.

8. Confidentiality

All client information, site data, and design materials are treated as confidential and used solely for the purpose of completing your project.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of Northern Ireland, and any disputes shall be subject to the exclusive jurisdiction of the courts of Northern Ireland.
